Terms and Conditions

These General Terms and Conditions apply to the use of the eGO Real Estate platform.

By subscribing to eGO Real Estate services, you accept these Terms and Conditions and all other policies and principles governing them. You also declare that Inmofocus, SAU. is a company governed by Spanish law, duly incorporated, and that all information provided by you is true and accurate, assuming full responsibility for its content and veracity.

Acceptance of these Terms and Conditions is absolutely indispensable for the use of the services provided.

Object and content

  1. The purpose of these Terms and Conditions ("Terms") is to grant the Customer a licence from Inmofocus, SAU. for an online platform ("eGO Real Estate Platform" or simply "Platform") for managing databases for real estate agencies or other entities with similar needs, which allows them, among other features, to manage their respective property portfolios.

  2. The eGO Real Estate platform is made available for the exclusive use of the purchaser, and its use outside the terms and conditions set forth herein is expressly prohibited.

Conditions for Access to the eGO Real Estate Platform

  1. Subscription to eGO Real Estate services is carried out by completing a form and subsequent contact with our commercial teams.

  2. Subscription to the service does not imply the acquisition of its intellectual property, and its use is permitted only during the valid subscription period and in accordance with these terms.

  3. eGO Real Estate shall not be held liable for data entered through the platform or the website; therefore, in the event of data loss, no liability may be attributed to eGO Real Estate. All graphic content of the pages (headers, scripts, icons) is the property of eGO Real Estate.

Website

  1. Template acquisition is carried out individually per website.

  2. The same purchaser may acquire additional templates to be applied to multiple websites, subject to individual payment for each one.

  3. Additional features may be acquired at any time, with an individual fee applied to each.

  4. We reserve the right to add or discontinue templates from the shop whenever deemed necessary.

  5. Feature activation is subject to the selected template.

Use of Bots and Non-Human Automation on the Website and eGO Real Estate

  1. The use of bots or any non-human automation in the provision of any service supplied to the client, such as the Website and eGO Real Estate CRM or any other service provided by Inmofocus, SAU. is strictly prohibited.

  2. Web scraping actions are not permitted on the client's websites. Any web scraping actions identified or detected by Inmofocus, SAU. will be immediately blocked.

Prices and Conditions

  1. Subscription to the service requires confirmation of an initial payment for the selected solution.

  2. The service is provided on a rental basis, with payment frequency corresponding to the subscribed plan and access to the conditions included therein.

  3. Service prices may be updated at any time, with a minimum of 60 days' prior notice guaranteed for any changes.

  4. The amounts presented are monthly, with annual, semi-annual, or four-monthly payment depending on the awarded plan.

  5. All plans have a minimum commitment period of 12 months. Cancellation before the end of this period will require payment of the remaining monthly fees.

  6. The client may change their service plan at any time, provided it is upgraded to a higher-tier plan.

  7. The indicated amounts are subject to VAT at the applicable legal rate.

  8. Should the client request the transfer of the domain to another server, an additional payment corresponding to the transfer costs will be required, never less than €129 + VAT. The domain transfer fee will be updated in accordance with the applicable price list.

Renewals

  1. Services are provided for an initial minimum period of 12 months and are automatically renewed for successive periods, unless the client provides at least 60 days' prior notice before the scheduled renewal date.

Cancellation or Withdrawal

  1. The service may be unilaterally cancelled by us whenever the obligations arising from these Terms and Conditions are not fulfilled.

  2. In the event of false information being provided or abusive use of the Service for any purpose contrary to these Terms and Conditions, we may cancel the service without prior notice.

  3. Cancellation of the service will result in the complete deletion of the database from our servers.

  4. Termination of the service must be requested with a minimum of 60 days' prior notice before the renewal date and does not entitle the client to any refund of remaining amounts.

  5. In the event of total withdrawal by the client from the execution of the contract, the client must pay Inmofocus, SAU. the total amount of the outstanding installments of the contracted and cancelled products or services.

Changes to Services or Prices

  1. eGO Real Estate reserves the right to modify or discontinue, temporarily or permanently, components of the service without prior notice.

  2. The price of all services, including monthly subscription services, may be changed at any time. The client will be notified in advance of any price changes.

Intellectual Property and Database

  1. eGO Real Estate reserves the right not to publish or to remove photographs that infringe privacy or publicity rights or violate these Terms of Service.

  2. Content entered into the eGO Real Estate platform belongs to its users and is their sole responsibility.

  3. Reverse engineering techniques may not be used to gain access to the eGO Real Estate platform.

User Creation

  1. The creation of false users through bots or other automated methods is not permitted.

  2. To complete the registration process, company identification, a valid email account, or any other requested information must be provided.

  3. Login access is individual and may not be shared among multiple users. User creation is limited to the maximum number allowed by the subscribed plan.

  4. The client is solely responsible for keeping user accounts and their respective passwords secure.

  5. The client is fully responsible for the content entered and activities carried out in the application using their user account.

  6. An entity or individual may only register once for access to the demonstration version. Simultaneous registrations are excluded.

  7. The service must not be used for illegal or unauthorized purposes. During use, applicable laws of the relevant jurisdiction, including copyright laws, must not be violated.

Disk Space

  1. Disk space will be provided in accordance with the subscribed plan. eGO Real Estate reserves the right to delete all data and free the corresponding disk space used by the client if the client withdraws from the services or if the services are suspended.

Number of properties

  1. The number of properties will be limited according to the plan subscribed.

Email Accounts

  1. This service includes a maximum number of email accounts depending on the subscribed plan and is subject to the acquisition of a proprietary domain. Email accounts are subject to a responsible use policy and may not be used for mass communications that may be considered spam. In such cases, eGO Real Estate may suspend the email service.

Initial Training

  1. The initial 6-hour training included in all plans will be provided by Inmofocus, SAU. remotely and divided into several sessions.

  2. All our customers have access to the eGO wiki, where they can find support tutorials.

Conditions of Use

  1. eGO Real Estate will clarify any questions regarding service usage through a technical support telephone help desk, online commercial chat, and a ticketing system.

  2. eGO Real Estate shall not be liable for any damages resulting from data loss, damages, suspension, interruption, or any other service anomaly not attributable to it.

  3. Use of eGO Real Estate requires a computer with the following minimum requirements: internet access (minimum speed of 1 Mbit) and an up-to-date browser (latest versions of Edge, Chrome, Safari, or Firefox).

  4. For proper viewing of eGO Real Estate websites, browsers should be kept up to date (latest versions of Edge, Chrome, Safari, or Firefox).

  5. The client must provide equipment meeting the indicated requirements, without which proper service provision cannot be guaranteed.

Portal Packs

  1. The service includes integration with one or more real estate portals and external websites that are not owned by eGO Real Estate but with which it has established commercial or technical partnerships.

  2. The transmission of information to and from portal and external website networks, involving third parties, is subject to varying response times for technical, administrative, or commercial interventions. Proper export of properties depends on the involved entities.

  3. The frequency of information updates selected by the client for publication on external portals and websites may vary from portal to portal.

  4. eGO Real Estate is responsible for transferring and making available the property database in accordance with the established protocol and is exempt from any technical failures or export limitations attributable to the portals.

  5. The service does not include publication of properties on portals where specific fees are charged by partners, account creation or pre-registration is required, or special criteria are imposed on properties to be published.

  6. eGO Real Estate reserves the right to change the composition of portal packs associated with the service without prior notice, undertaking best efforts to include new portals whenever a portal is removed from a pack.

  7. Portals offered as part of a plan may be changed at any time, as such offers remain valid only while agreements with third parties are in force.


GDPR Kit

  1. eGO Real Estate complies with the General Data Protection Regulation (GDPR – EU Regulation 2016/679), acting as a data processor in the processing of personal data. The data controller is the client who acquires the eGO Real Estate solution and must obtain consent from data subjects and ensure compliance with legal obligations before competent authorities.


Website

  1. Registration of Consent for Data Collection and Use in Website Forms (Customizable): Your website will store, in eGO Real Estate, all data entered by users and clients when completing forms. In addition, data such as IP address, form submission time, among others, will also be stored. You may customize the message presented to users when submitting the form — the consent record.

Customization of the Terms and Conditions Page

  1. A “model” Terms and Conditions page will be made available to you for customization, ensuring that website users receive all legally required information.

Customizable Cookie Bar

  1. The Kit also allows customization of the cookie policy message on your website in accordance with your company’s objectives.


eGO Real Estate Software

  1. User Consent Certificate in PDF: When a user consents to data usage on your website, a Consent Certificate is automatically generated in eGO Real Estate and associated with the user's record. This Certificate serves as legal proof of authorization for data collection and use by your company.

  2. Client Profile Page with the possibility to update data and exercise the right to be forgotten. Each contact will have private access to a personal page where they may exercise their right to data rectification and/or erasure. This information is managed by the contacts and validated by you.

Email Marketing

  1. Editable Consent Request Communication Template: Three email templates are provided for sending consent requests to contacts. As consent is obtained, eGO Real Estate reorganizes the database, increasing the number of clients with whom communication is permitted.


Google Services

  1. Use of Google calendar and contacts functionalities by eGO Real Estate requires acceptance of Google's terms available at https://policies.google.com/terms and https://policies.google.com/privacy.

  2. Use of YouTube functionalities requires acceptance of YouTube's terms and conditions available at https://www.youtube.com/t/terms.

  3. At any time, authorizations granted to eGO Real Estate may be viewed and revoked at https://security.google.com/settings/security/permissions.

Duties and Responsibilities

  1. A server uptime of 99% is guaranteed, which may result in downtime equivalent to up to 3 days per year. If exceeded, the Client will be compensated, without exceeding the value of one monthly fee.

  2. We are not responsible for the correct or timely publication of data transmitted to partner portals; our responsibility is limited to exporting the database.

  3. Management of user permissions is the responsibility of the client. Support may be requested from Inmofocus, SAU. however, liability for conflicts, data alteration, data theft, or damages resulting from poor permission management rests solely with the client.

  4. eGO Real Estate reserves the right to modify or amend the Terms of Service at any time. Changes take effect immediately upon publication. Continued use implies acceptance.

  5. Acceptance of the Terms of Service is indispensable for use of the services provided.

User Responsibilities

  1. The user undertakes to:

    • Obtain explicit consent from clients before collecting or processing personal data;

    • Do not use the system for illegal, misleading or purposes outside the scope of your activity;

    • Protect access credentials and the confidentiality of processed information;

    • Comply with all reporting and registration obligations imposed by entities and authorities in your sector of activity.


TikTok Feature Usage

  1. Content Responsibility: The user is solely responsible for the content (images, captions, and hashtags) published on TikTok through the eGO Real Estate platform.

  2. TikTok Compliance: All publications must fully comply with TikTok's Community Guidelines and Terms of Service. Janela Digital reserves the right to suspend the functionality if abusive use is detected (e.g., spam).

  3. Service Availability: The publishing feature depends on third-party infrastructure (TikTok API). Janela Digital does not guarantee uninterrupted service in case of outages or changes to the social network's policies.

  4. Intellectual Property: By publishing content, the user declares that they own all image and intellectual property rights to the uploaded files.
